Medical Malpractice
Mr. Zilba’s practice also includes the handling of claims against hospitals, nursing homes and other medical professionals or entities for negligence. This includes doctors, nurses, chiropractors and other health care providers.
If you believe a medical error has seriously injured you or a loved one, you must be sure to seek competent legal advice as soon as possible. Generally, Ohio law only allows an individual one (1) year within which to file a lawsuit on their claim or it will be forever barred. There are a number of exceptions/nuances to this period of limitations, which may extend your filing time, however, be sure to have the case assessed as soon as possible to protect your rights.
When considering whether to bring a claim against a medical practitioner, many people are reluctant or even ashamed to pursue their case because of recent public relations campaigns launched by the insurance and medical industries against the injured and their lawyers. This so-called “medical malpractice crisis” is not the fault of innocent victims or their advocates. Consider the following facts on the alarming frequency of medical errors:
The National Academies, Institute of Medicine (IOM) Committee Report released in 2000 noted “there are at least 44,000 patient deaths from medical errors each year, placing this as the eighth leading cause of death in the United States, and the figure could be as high as 98,000 deaths". “Medical errors are responsible for more deaths than either motor vehicle accidents or breast cancer” (IOM report).
Based upon these disturbing figures, annual deaths associated with medical malpractice is equivalent to a jumbo jet with 270 persons aboard crashing each and every day in the United States, killing all aboard. And this is only counting those whose lives are terminated from medical malpractice, not those who survive! Would we tolerate such a record from the FAA? Should we tolerate it from the AMA?
Physicians, nurses and others in the health care field have a duty to provide care that meets the applicable “standard of care” in their profession. If they do not, and injury or death results, they are liable.
